Event Entry Terms and Conditions Sunday August 26, 2018

1.Entry into “The Sunday Mail Bridge to Brisbane Fun Run 2018”, a fun run/walk event consisting of a 10km and 5km event (“Event”), to be hosted on Sunday August 26, 2018 (“Event Day”) by Queensland Newspapers Pty Ltd (“Event Organiser”) is deemed acceptance of these entry terms.

2.The Event is managed by Event Management Solutions Australia Pty Limited ABN 15 156 444 496 (the “Event Manager”). They act on behalf of the “Event Organiser” to provide event services.

3.Entries close:

a.online at www.bridgetobrisbane.com.au on Friday August 24, 2018 at 11:59pm;

b.in person at the Race Office on Saturday August 25, 2018 at 12:00pm; and

c.by post, when the last post is received on Sunday 5 August , 2018;

d.All teams need to have their post entries submitted by Sunday August 5, 2018 or a late processing fee will be administered for all entries received after this date.

4.All entrants must complete and submit an online entry form and pay the applicable entry fee at time of entering and wear at all times during the Event the official 2018 race number with timing device supplied to each entrant accepted and registered by the Event Organiser.

5.Entry is not transferable and is only valid for the person whose name and address details are listed in the entry form.  All entrants acknowledge any attempt to transfer an entry or allow another person to participate in the Event under the entrant’s name without the Event Organiser’s knowledge may void any applicable insurance and the entrant will be disqualified from the event resulting in no recorded race time.

6.Only 30,000 entrants will be accepted for participation in the Event on event day Sunday August 26, 2018. Once this number is exhausted entries will close and any entries received after this time will not be able to be processed and will be notified by Event Organiser.

7.Each entrant acknowledges insurance may be in place that may provide limited cover to entrants while they are participating in the Event.  Entrants understand this insurance will not cover them for all personal injuries, death and/or damage sustained during the Event.  Entrants also acknowledge they may be able to, in their own interests and at their own expense, seek and obtain personal insurance in addition to any cover provided by the Event Organiser.

8.To qualify as a finisher in each of the 10km and 5km Events, entrants must assemble behind the designated start line, await official start, and then finish the course along the exact route listed on the website www.bridgetobrisbaneday.com.au.  Entry into the course prior to the official start will result in disqualification, resulting in no recorded race time.

9.Each entrant acknowledges participation in the Event can be inherently dangerous and they are exposed to certain risks during the Event, including personal injury, death and/or property damage/property loss resulting from their participation, including, overexertion, equipment failure, dehydration, serious accidents and course and weather conditions.

10.Each entrant acknowledges they will be, at the time of the Event, medically and physically fit for the Event and unaware of any illness, injury or any other physical disability or impairment which may cause personal injury, death and/or property damage to them or anyone else while participating in the Event.

11.Each entrant will provide via the online entry form or otherwise, details of any medical or physical condition that may affect their performance or be relevant if medical treatment is needed.  Each entrant accepts all risks of participating despite their medical and/or physical condition and forever releases and indemnifies to the fullest extent permitted by law the Event Organiser, the Event Manager, the Event Sponsor or any other Event sponsors, Event volunteers; the owners, licensees and occupiers of land upon which any part of the Event is conducted; any statutory body or local authority having control over any land upon which any part of the Event is conducted; their related bodies corporate and their officers, employees, members and/or contractors and any other person from and against all claims, loss (including consequential loss) and/or costs (including legal costs), whether or not legal proceedings are instituted, irrespective of the means, manner and/or nature of any settlement or determination arising directly and/or indirectly out of, and/or in connection with, the entrant’s participation in the Event, including any Event competitions and/or prize draws.

12.If the release and indemnity provisions as stated in clause 12 are determined to be void, each entrant forever releases and indemnifies the Event Organiser, the Event Manager,  the Event Sponsor or any other Event sponsors, Event volunteers; the owners, licensees and occupiers of land upon which any part of the Event is conducted; any statutory body or local authority having control over any land upon which any part of the Event is conducted; their related bodies corporate and their officers, employees, members and/or contractors against all death or personal injury claims arising out of the entrant’s participation in the Event.

13.Each entrant consents to receiving any medical treatment, including ambulance transportation, the Event Organiser considers desirable during or after the Event.  In the event of an emergency, the entrant authorizes their personal details to be shared with appropriate parties, including, but not limited to, the Event Organiser, Event Manager, medical staff and the entrant’s Emergency Contact. The Event Organiser and/or Event Manager has the right to contact the entrant or their listed Emergency Contact as they consider necessary or desirable during or after the Event.

14.Each entrant acknowledges it is their responsibility to ensure they are appropriately hydrated while participating in the Event.

15.Each entrant acknowledges their entry fee is not refundable.

16.Should an entrant  not compete for any reason or the Event is cancelled or changed by the Event Organiser due to reasons beyond the reasonable control of the Event Organiser such as bad weather or for safety reasons entry fee is not refundable

17.Each entrant acknowledges that they have sole responsibility for their personal possessions and athletic equipment during the Event and related activities. The Event Organiser and the Event Sponsor are not liable for any damaged/lost goods.

18.All entrants must wear their 2018 official race number (which will contain the timing device) – without this race number you will not be allowed to start the Event, and will not receive a race time.  Please do not tamper with the timing device strips on the back of the race number as you may destroy the timing technology and will not receive an official race time.

19.Each entrant consents to, without being compensated in any way, the publication and/or use in any form of media and marketing whatsoever by the Event Organiser, Event Manager or the Event Sponsor or any other Event sponsors, of their name, image, voice, race number, statements, and photographs and films of them taken by the Event Organiser or its contractors, in any context pertaining to the Event or otherwise before, during or after the Event for advertising, promotions or otherwise. Each entrant’s race time will be published on  the website http://www.couriermail.com.au.  Event organisers do not take any responsibility for the information that search engine’s store.

20.Each entrant understands they are not able to collect their Event information kit (including official race number with attached timing device and Event information booklet) on the Event Day. Event race numbers need to be collected prior to 2:00pm Saturday August 25, 2018 from the Race Office during race office hours.

21.The official race office will be announced closer to the date and be open between Thursday 23 and Saturday 25 August, 2018.

22.Each entrant understands their entry form and payment is valid only for the Event distance they have nominated in the Event. Entrants can only participate in the category in which they register; entrants will be disqualified if they compete in a distance other than the distance nominated.

23.Individual entrants can enter and compete in both 10km and 5km Events, but will be ineligible to win both.  The entrant’s 10km result will be deemed their registered time and awardable prize if applicable.

24.Entrants running with strollers can register for any category (excluding the 5km Elite or 10km Elite categories), but must start at the back of their category.

25.To be eligible to register in the 10km Event Blue Elite or Red Runner categories in 2018, male and female entrants must have achieved a maximum official result of 40min and 50min, respectively, in the 10km Event in 2017. Official results from similar events of the same distance will be considered by the Event Organiser.

26.To be eligible to win the 1st, 2nd or 3rd team category in the 10km or 5km event all team members must run in their own race number.  If another team member runs in the event using another team member’s race number the team will be disqualified. Team category winners will be based on the top five fastest times within a team.

27.To be eligible to register in the 5km Purple Elite category in 2018, male and female entrants must have achieved a maximum official result of 20min in the 5km Event in 2017. Official results from similar events of the same distance will be considered by the Event Organiser.

28.Entrants can enter a team with a minimum of 5 participants in the 5km or 10km Event. A team must compete in the same Event distance and category. A team entry must be sent or delivered at the same time, with sufficient payment to cover all entrants.

29.If an entrant is under 18 years of age, a parent or guardian must accept and agree to the terms in the waiver for their child/children/subjects.  The parent/guardian is also responsible for the health and safety of their child/children/subjects of guardianship competing in the 5km or 10km Events at all times.

30.Entrants will only be permitted to walk or run unassisted, without the aid or use of prohibited items such as bikes, skateboards, rip sticks, rollerblades or similar items when competing in the Event, with the exception of entrants in strollers, wheelchairs or similar devices.

31.Pets, except guide dogs, are not permitted. Participants who have assistance animals, excluding guide dogs, are required to contact the Event Organisers.

32.Strollers, wheel chairs and similar devices must have appropriate safety restraints and meet Australian Safety Standards.

33.To meet the road closure re-opening schedule, Event course cut off times will apply. To ensure the safety of all entrants, any entrant who is unable to meet the Event course cut off times will not be permitted to remain on the roadway. These entrants will be requested to board the official support buses to escort them to the finish site.

34.All entrants acknowledge they will abide by any reasonable directions issued by the Event Organiser, Event Manager and the Police.

35.All entrants acknowledge that the Event Organiser or the Event Manager may remove the entrant from the Event area and/or exclude the entrant from participation in the Event:

  1.   if the entrant’s behaviour is inappropriate, offensive, or abusive;
  2.   to prevent damage to any property;
  3.    on medical or health and safety grounds (including to prevent possible harm or injury to the entrant or any other person), or (b) to prevent or arrest any form of unauthorised marketing, including ambush marketing.

36.The Event Organiser may collect personal information about entrants, including the information they provide upon entry.  The Event Organiser collects this information for the purpose of processing entries, providing services to entrants, providing entrants with information about other services the Event Organiser offers that may be of interest to entrants (“Secondary Purposes”), facilitating the Event Organiser’s internal business operations, including the fulfillment of any legal requirements, and analysing the Event Organiser’s services and customer needs with a view to developing new and/or improved services.

37.At any time entrants may notify the Event Organiser they do not want the Event Organiser to use their personal information for Secondary Purposes by contacting the Event Organiser by any of the following methods: Email info@bridgetobrisbane.com.au Mail: The Privacy Officer, Queensland Newspapers, GPO Box 130, Brisbane QLD 4001.  Please allow a reasonable time for your preference to be implemented.

38.The entrant acknowledges the Event Organiser will be entering his or her personal details contained on the entry form into a database which will be used for the administration of the event, including to email and SMS event information to them if they have provided an email and/or mobile phone number. Unless otherwise indicated by entrant on this entry form.

39.If the personal information entrants provide to the Event Owner or Event Organiser is incomplete and/or inaccurate, the Event Organiser may be unable to process their entry and/or be unable to provide entrants with the services they are seeking.

40.Entrants may access the personal information the Event Organiser holds about them in accordance with the Event Organiser’s privacy policy.

41.Entrants that register online will be asked if they wish to fundraise towards their chosen charity via EveryDay Hero by ticking the box in the registration process. By doing this the entrant grants to the Event Organiser the right to transfer their name, email and phone number to the EveryDay Hero – The Sunday Mail Bridge to Brisbane event page where they can then begin fundraising on their charity page.

42.Team registrations or mail registrations will need to visit www.bridgetobrisbaneday.com.au to manually set up their team EveryDay Hero page.

43.The entry fees for the Event are:

a.10km – $52.00 (inc GST) March 25, 2018 – June 30, 2018 (Early Bird)

b.5km – $42.00 (inc GST) March 25, 2018 – June 30, 2018 (Early Bird)

c.10km – $57.00 (inc GST) July 1, 2018 – August 25, 2018 (General Entry)

d.5km – $47.00 (inc GST) July 1, 2018 – August 25, 2018 (General Entry)

The cover price of the Thursday 23/08, Friday 24/08, Saturday 25/08 edition of The Courier Mail (to be collected with your “Race Pack”) and or The Sunday Mail 26/08 (at the conclusion of the event) is included in your B2B entry fee.

Terms and Conditions – Bridge to Brisbane Participants – Win a Fiji Holiday

General

  1. The Promoter is Queensland Newspapers Pty Ltd trading as News Queensland (ABN 61 009 661 778) of Cnr Mayne Road and Campbell Street Bowen Hills QLD 4006 Telephone number 1300 696 397.
  1. Information on how to enter and prizes forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
  1. If there is any inconsistency between these Terms and Conditions and anything else that refers to this competition, these Terms and Conditions will prevail.

Who can enter

  1. Entry is open to all registered participants of Bridge to Brisbane 2018 except employees and immediate families of the Promoter and their associated companies and agencies, and except all Bridge to Brisbane event sponsors and partners. Immediate family includes the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or first cousin.
  1. Entrants under 18 years of age must obtain the prior permission of their parent or legal guardian in order to be able to enter. The Promoter may require any such entrant’s parent or legal guardian to sign a release at the Promoter’s discretion in which the parent or legal guardian accepts responsibility for the acts and forbearances of the winner. The release will include the parent or legal guardian’s full name, address and telephone number. Failure to agree to the release and provide these details will invalidate the winner’s entitlement to the prize, subject to State and Territory legislation.  If the competition winner is under 18 years of age, the prize will be awarded to the winner’s parent or legal guardian.
  1. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity or proof of registration ownership in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

When to enter

  1. The competition commences at the start of the Bridge to Brisbane race entry registration period (including Early Bird entries) from 29 March 2018, 12:01am AEST. The competition concludes at the end of the Bridge to Brisbane race entry registration period on 24 August 2018, 11:59pm AEST. Entries must be received by the Promoter prior to the competition close date and time.
  1. The time of entry will in each case be the time the online race registration is received by the Promoter’s database, not at the time of transmission by the entrant.
  1. The Promoter accepts no responsibility for any late, lost or misdirected entries including SMS messages not received by the Promoter or delays in the delivery of the SMS message due to technical disruptions, network congestion or for any other reason. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account is invalid and will not be accepted.

How to enter

  1. Entrants will automatically be placed into the competition after successfully registering and paying for their Bridge to Brisbane race entry in the Sunday 26 August 2018 race. Only one (1) entry into the draw per valid registration. Registration for Bridge to Brisbane race entry includes logging onto bridgetobrisbane.com.au and registering their details including, but not limited to, full name, address, date of birth, gender, and email address. The maximum cost of registration is up to $57 per entry (10km course, general entry rate). The cost of accessing the promotional website will be dependant on the entrant’s individual Internet Service Provider.

 

  1. Entrants are required to take full responsibility for the content of their entry and for ensuring that their entry complies with these terms and condtions. For the purposes of these content requirements, “entry content” includes any content (including text, photos, videos and email messages) that entrants submit, upload, transmit, publish, communicate or use in connection with their entry into the Promotion. Entries must be the entrant’s original work.  The Promoter reserves the right to verify, or to require the entrant to verify, that the entry is the entrant’s original work.  If an entry cannot be verified to the Promoter’s satisfaction, the entry will be deemed invalid.  The Promoter may, in its absolute discretion, edit, modify, delete, remove or take-down any part of an entrant’s entry.  An entrant’s entry must not include:
  • any image or voice of any other person without that person’s express consent.  Entrants warrant that if any such content is included, they have obtained the express consent of the relevant person;
  • any content that contravenes any law, infringes the rights of any person or is potentially insulting, inflammatory, defamatory, obscene, offensive, discriminatory, indecent or otherwise objectionable or inappropriate (which includes, without limitation, any content involving nudity, malice, excessive violence or swearing); and
  • any literary, dramatic, musical or artistic work, any audio-visual or sound recording, or any other item in which copyright subsists, unless the entrant is entitled to do so.  If an entrant has any doubts about whether they have the right to include any content (for example, recorded music) they must not include it.  By including any such content in their entry, the entrant warrants that they have the permission of the relevant copyright owner to do so and that this permission allows the Promoter to use the entry in accordance with these terms and conditions.

The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

  1. Any entry that is made on behalf of an entrant by a third party will be invalid, unless the entrant requires the assistance of a third party to enter due to a disability.
  1. The Promoter reserves the right to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple purchases.

Number of Entries permitted   

  1. Only one entry per valid registration Only one prize will be awarded per person.

Draw and Notification of winner

  1. The winner will be the first valid entry submitted in accordance with these terms and conditions that is drawn by The Promoter by random computer selection at 3:00pm AEST on 25/08/18 at the Bridge to Brisbane Finish Village, Little Stanley Street, Southbank.
  1. If any particular draw is scheduled on a public holiday, the draw will be conducted on the following business day.
  1. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the competition result or any other decisions the Promoter makes in connection with the Promotion.
  1. The winner will be announced at the Bridge to Brisbane Finish Village at Southbank. Winner does not need to be present to claim prize. The winner will also be notified by email within three days of the draw. Travel prize voucher will be posted or couriered to the winner within 14 days after the winner has been contacted. Winner of prizes will be published on bridgetobrisbane.com.au and on www.couriermail.com.au/competitions on Friday 29 August 2018.
  1. Prizes will be awarded to person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder).
  1. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
  1. Subject to State Regulation, an unclaimed prize draw will take place at Cnr Mayne Road and Campbell Street Bowen Hills QLD 4006 on 3/12/2018 at 10am, AEST. The winner/s of the unclaimed prize draw will be notified by email within two days of that draw.

Prize on offer

  1. Individual prize value is up to $5,000 (including GST). Total prize pool value is up to $5,000 (including GST).   One winner will receive:
  • One (1) x $5,000 Flight Centre voucher.
  1. Unless otherwise expressly stated, prize values are based upon the recommended retail prices at the time of first publication of these Terms and Conditions (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
  1. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
  1. Prizes cannot be transferred, exchanged or redeemed for cash.

 

  1. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. It is the responsibility of the winner to confirm such conditions with the prize supplier or other relevant third parties.
  1. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. If an entrant under 18 years of age wins a prize then their parent or guardian must sign the legal release referred to in this clause on the minor’s behalf.
  1. All entrants agree that if they win the prize, they will not, and their companions will not, sell or otherwise provide their story and/or photographs to any media or other organisation, including the internet. Photographs will be allowed only at the discretion of the Promoter.

 

  1. Flight Centre voucher must be redeemed prior to the expiry date shown on the voucher or the time period specified or vouchers will be forfeited and no cash payment or further prizes will be awarded. Unused portions of any prize voucher are non-refundable.
  1. Where the prize involves driving, travel or participation in an event, winners or any companions under 18 years of age must be accompanied by their parent or legal guardian at all times.
  1. Gift vouchers are subject to the terms and conditions imposed by the gift card provider. Once awarded, the Promoter is not liable for any voucher that has been lost, stolen, forged, damaged or tampered with in any way.
  1. The winner acknowledges and accepts that activities that may form part of the prize are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may take place. The winner must make his or her own enquiries about local issues and conditions at destinations prior to travel.
  1. The winner/s (and their companion/s) is/are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. The winner is responsible for ensuring that they and their travelling companion(s) are fit to travel and have received appropriate immunisations and/or health checks prior to taking the prize.
  1. If the winner/s is under the age of 18 as at the date of the draw, an adult must accompany the minor in the participation of the prize.
  1. The winner and his or her travel companion are responsible for complying with health and any other government requirements that may apply to the prize. All prize travel will be subject to the carrier’s General Conditions of Carriage. It is the traveller’s personal responsibility to ensure that they have valid travel documentation, including valid passports and visas, which meet the requirements of government authorities at the relevant destinations. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. Entrants should obtain travel advice from independent sources, such as the web site of the Australian Department of Foreign Affairs and Trade.

Further Terms and Conditions

  1. Subject to complying with all relevant State and Territory legislation, the Promoter reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of the competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.
  1. The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
  1. If for any reason this competition is not capable of running as planned, including (without limitation) due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, the Promoter reserves the right in its sole discretion take any action that may be available, and (without limitation) to cancel, terminate, modify or suspend the competition, subject to any direction given under State Regulation.
  1. Entrants are responsible for any cost associated with accessing the promotional website . Access to that site is dependent on the Internet service provider.
  1. Any entrant found to be using any form of software or third party application to enter multiple times (including scripting software) will have all entries invalidated and any claim to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
  1. An entrant may not use a third party (including online competition entry site) to enter on their behalf, except where the entrant needs to use those services of that third party to enter due to a disability.  If the preceding sentence has been breached, the entrant will have all entries invalidated, any claim to any prize will be invalidated and where such an entrant has already been awarded a prize before being found to have breached this clause, the entrant must immediately return any awarded prize to the Promoter.  The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
  1. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State and Territory legislation. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
  1. The Promoter will make reasonable efforts to deliver prizes to the addresses provided by competition entrants. If a prize is returned to the Promoter because it could not be delievered to the address provided, the Promoter cannot guarantee that it will be able to resend the prize to theprize winner. The Promoter and its associated agencies and companies will not be liable for any damage to or delay in transit of prizes.
  1. The Promoter reserves the right to redraw the prize if an entrant who claims to be a prize winner is unable to satisfy these terms and conditions.

Copyright, Statutory guarantees, Waiver and liability

In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s submission, image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with the Promoter or News Limited publications or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
  1. The Promoter acknowledges that the entrant may own intellectual property rights (including copyright) in any material created or otherwise submitted to the Promoter in connection with the entrant’s entry or participation in any aspect of the prize (Works). The entrant hereby grants the Promoter a non-exclusive, irrevocable, perpetual, worldwide licence to use the Works (including modifying, adapting or publishing the Works, whether in original or modified form, in whole or in part or not at all). The entrant acknowledges and agrees that neither the entrant nor any third party shall be entitled to any fee, royalty or other consideration in respect of such licence.  If the entrant holds, now, or at any time in the future, any so called “droit moral” or moral rights in connection with the Works, the entrant unconditionally and irrevocably consents, for the benefit of the Promoter and all of its assignees, licensees and sublicensees to material alterations to the Works (including, without limitation, any copying, editing, adding to, taking from, adapting and/or translating the Works, in any manner or context) for any purpose, notwithstanding that such conduct may amount to derogatory treatment of the Works for the purposes of the Copyright Act 1968 (Cth).
  1. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.
  1. The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act (2010) (Australian Consumer Law) which cannot be excluded, restricted or modified. However, the remainder of this clause will apply to the fullest extent permitted by law and the Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by entrant or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

The Promoter collects personal information about you for the purposes of conducting this promotion. Any disclosure of such information will be made as required by law and in accordance with these terms and conditions but no further use of this information will be made without prior consent.
